By accessing and using StoreAI ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service are effective as of the date you first access StoreAI and shall remain in full force and effect while you use the Service.

We reserve the right to modify these terms at any time. Your continued use of StoreAI following the posting of revised terms means that you accept and agree to the changes.

StoreAI is an AI-powered e-commerce store builder platform that allows users to create and manage online stores with various features including:

We reserve the right to modify or discontinue the Service at any time, with or without notice.

To use StoreAI, you must register and maintain an active account. You are responsible for maintaining the confidentiality of your password and account information.

You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.

You are solely responsible for all activities that occur under your account. You agree to notify StoreAI immediately of any unauthorized use of your account.

StoreAI reserves the right to refuse service to anyone for any reason at any time.

Each account is for personal or business use only. You may not share your account with others or use another person's account.

You agree not to use StoreAI for any unlawful purpose or in any way that could damage, disable, or impair our servers or networks connected to the Service.

Prohibited conduct includes:

• Harassing, threatening, embarrassing, or causing distress or discomfort to any person or company

• Obscene, offensive, or sexually explicit content

• Commercial solicitation or spam

• Intellectual property infringement or violation of third-party rights

• Reverse engineering, decompiling, or attempting to discover the source code

• Uploading files that contain viruses, malware, or any other harmful code

• Attempting to gain unauthorized access to protected areas of the Service

StoreAI and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by StoreAI, its licensors, or other providers of such material.

You are granted a limited, non-exclusive, non-transferable license to use StoreAI for personal or business purposes, subject to these terms.

You retain all rights to any content you create using StoreAI. However, you grant StoreAI a worldwide, non-exclusive, royalty-free license to use, copy, modify, and distribute your content for the purpose of providing and improving the Service.

You may not reproduce, distribute, display, or transmit any content from StoreAI without our prior written permission.

The StoreAI name, logo, and all related marks are trademarks of StoreAI.

You are responsible for all content you upload, publish, or display through StoreAI, including product descriptions, images, prices, and other information.

You warrant that:

• You own or have the necessary rights to the content you upload

• The content does not infringe on any third-party intellectual property rights

• The content does not violate any applicable laws or regulations

• The content is accurate and not misleading

StoreAI does not pre-screen user content but reserves the right to remove any content that violates these terms.

You are solely responsible for maintaining backups of your content. StoreAI is not liable for any loss of data.

Pricing for StoreAI plans is displayed on our website and is subject to change with 30 days' written notice.

Billing cycles are monthly or annual as selected by you. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Special offers and promotional pricing are valid only for the specified period. After the promotional period ends, standard pricing applies.

You authorize us to charge the payment method on file for all applicable fees. If payment fails, we may suspend your account until payment is received.

Refund Policy:

• Refunds are available within 7 days of purchase for monthly plans

• Annual plans may be refunded within 30 days if the store has not generated revenue

• No refunds are provided for partial months or for usage exceeding fair use limits

• Special promotional offers are non-refundable

While StoreAI offers generous limits on products, storage, and bandwidth, we reserve the right to limit usage that exceeds normal business use or that adversely affects the Service.

Fair use includes:

• Operating a single store or a reasonable number of stores for your business

• Uploading products and content related to your business

• Normal website traffic and e-commerce transactions

Excessive use includes:

• Using StoreAI as a file storage service

• Excessive data transfers or bandwidth usage

• Operating numerous stores for resale purposes without proper licensing

We will notify you if your usage violates this policy and may take corrective action if the issue is not resolved.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STOREAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF STOREAI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our liability is limited to the amount you have paid to StoreAI in the 12 months preceding the claim.

Some jurisdictions do not allow the limitation or exclusion of liability, so some of the above limitations may not apply to you.

You agree to indemnify and hold harmless StoreAI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of StoreAI in violation of these terms

• Your violation of any applicable laws or regulations

• Your infringement of any third-party intellectual property rights

• Content you upload or create using StoreAI

• Your conduct or interactions with other users

StoreAI may integrate with or link to third-party services including payment gateways (Razorpay, PayPal, Stripe, Paystack, Flutterwave), social media platforms, and analytics services.

StoreAI is not responsible for the content, accuracy, or practices of third-party services. Your use of third-party services is governed by their terms of service and privacy policies.

We are not liable for any issues, disputes, or damages arising from your use of third-party services.

You are responsible for reviewing the terms and privacy policies of any third-party services you use through StoreAI.

Your use of StoreAI is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

We comply with applicable data protection laws including GDPR and CCPA.

You are responsible for protecting customer data you collect through your store and complying with applicable privacy laws.

StoreAI provides tools and features to help you manage customer data, but you retain responsibility for customer privacy and data protection.

StoreAI may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these terms.

You may terminate your account at any time by contacting our support team. Upon termination, your store will be deactivated, but your data will be available for download for 30 days.

After 30 days, your data will be permanently deleted from our servers.

Sections that are intended to survive termination include Intellectual Property Rights, Indemnification, and Limitation of Liability.

Any dispute arising out of or relating to these terms or the Service shall first be resolved through good faith negotiation.

If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

The arbitration shall be conducted in English and shall take place in a location mutually agreed upon by the parties.

Each party shall bear its own costs and attorney's fees, unless the arbitrator determines otherwise.

This section does not prevent either party from seeking injunctive relief in court to prevent irreparable harm.

STOREAI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free

• Defects in the Service will be corrected

• The Service or servers are free of viruses or harmful components

YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

You agree to comply with all applicable laws, regulations, and export controls in your jurisdiction and in the jurisdictions where your customers are located.

StoreAI is not responsible for your compliance with local laws regarding product sales, taxes, privacy, or consumer protection.

You are responsible for obtaining all necessary licenses and permits to operate your online store.

StoreAI reserves the right to refuse service to businesses engaged in illegal activities or selling prohibited items.

StoreAI offers free setup assistance to help you launch your store successfully. This includes:

• Store configuration and customization

• Product upload and organization

• Payment gateway setup

• Theme selection and basic customization

• Training on store management

Response times are subject to support availability. We aim to respond within 24-48 hours during business days.

Support services are provided on a best-effort basis and do not include custom development or unlimited customization.

Entire Agreement: These terms constitute the entire agreement between you and StoreAI regarding the Service.

Severability: If any provision is found to be unenforceable, the remaining provisions shall remain in full force.

Waiver: Our failure to enforce any right does not constitute a waiver of that right.

Governing Law: These terms are governed by and construed in accordance with the laws of the jurisdiction where StoreAI is incorporated, without regard to conflict of law principles.

Assignments: You may not assign these terms or your account to any other person or entity without our written consent.
